Heading up (to head to wind) an overtaking boat up that is flying a spinnaker

The boats are Ideal 18s
Let's say you round the windward mark, leaving it to your left and you start the downwind leg, staying on starboard tack.
You don't immediately raise your spinnaker.
Another boat rounds behind you also on starboard, is windward of you and raises their spinnaker.
You start to head them up and it's fairly easy for you to head up because you haven't raised your spinnnaker.
Do they get any special time to keep clear of your leeward boat because they've got to deal with a spinnaker and it gets them into a mess as they head up and the spinnaker collapse back onto the forestay? After which you could fall off and get your spinnaker up.
My guess is that they would try to delay heading up, saying you have to give them more room, that they can't head up quickly because of the spinnaker, or something, and hope they might be able to sail by you and get around you.  Do they get any extra "room" to keep clear because they are flying the spinnaker?
Is this an acceptable and common tactic to head someone up in this scenario?
